As construction thrives in Texas and the Southwest, the need for experienced counsel grows as well. “Construction” encumbrances many constituencies and the hands-on experience needed to serve this industry must run from contract to completion and every point in between.
Underwood serves the construction industry in each of its markets; however we boast particular substantive knowledge in our Fort Worth office, where two of our lawyers devote the bulk of their practices to construction law. Those lawyers are leaders in various construction law organizations, and each was recently named a “Top Attorney” in construction practice by Fort Worth Texas magazine.
Firm-wide, we work with owners, developers, contractors, construction managers, lenders, suppliers, and sureties. We handle all facets of contracting, including assistance in the competitive bidding process.
Many members of our Litigation Practice Group are well versed in construction law, and when things go wrong, Underwood brings a team approach to crafting cost-effective solutions wherever possible, and providing representation in litigation and arbitration proceedings throughout Texas. Our lawyers’ service as mediators, arbitrators, and receivers can bring unique insight to parties who find themselves in these special proceedings and dispute resolution processes.
The flow of payment on any project is critical to all parties at all phases of construction. Our construction lawyers are well versed in the complex web of prompt payment and mechanic’s and materialman’s lien laws. Likewise, we have long dealt with projects that are impacted by performance and payment bonds, and in particular, proper submission of bond claims for unpaid suppliers and subcontractors, which can be of particular importance in government and public sector projects, both on a state and federal level.
