Post-divorce Property Issues

Sometimes property issues remain after the divorce is over. These property issues can include:

  • Division of property not divided in the divorce
  • Retirement division orders, such as qualified domestic relations orders
  • Enforcement of an order requiring delivery of personal property, including financial assets
  • Payment of money existing at the time of the divorce
  • Payment of money that would arise after the divorce, such as installment payments
  • Execution of documents, such as deeds and powers of attorney
  • Clarification of a court order

These suits are typically shorter than a divorce suit since the scope is limited. They can however involve complex legal issues, such as whether the requested relief is a prohibited modification of the property division after the divorce is final. Sometimes a party will request that the opponent be found in contempt of court and be jailed for failing to comply with a court order. There are specific rules for bringing and defending against those enforcement actions. Knowledge of those rules can make an enormous difference in the outcome of the case.
