On Wednesday, October 26, 2011, Underwood Attorneys Slater Elza, Ann Manning, and Bryan Guymon were the featured speakers at the Texas Municipal Clerks Association (“TMCA”) South Plains Chapter Meeting. Ann Manning made a presentation about redistricting and how it affects cities. Slater Elza gave three presentations during the meeting. First, Slater discussed various aspects of nuisance law, specifically junked vehicles, abandoned vehicles, and weed ordinances. Next, Slater presented on ethics issues and particularly how to avoid conflicts of interest. Third, Slater gave an update on the City of Dallas v. Steward case, in which the Texas Supreme Court held that nuisance decisions should be made by courts rather than City Boards. Slater discussed the implications that this court decision, and the pending request for re-hearing, may have on municipalities throughout the State. Bryan Guymon first gave a presentation on resolutions, ordinances, and proclamations. Bryan was assisted by Kirk Franklin of Franklin Legal Publishing with the ordinances section of that presentation. Bryan also gave an update on the Texas Open Meetings Act. Finally, Slater and Bryan conducted a discussion regarding S.B. 100 and how it affects Municipal elections.
