Underwood Law Attorneys Win U.S. Supreme Court

Underwood attorneys Slater Elza, Stephanie James, and Brad Timms recently achieved a significant victory in the Fifth Circuit Court of Appeals, and the U.S. Supreme Court has now denied the other party’s request to appeal the decision.

Underwood represented a multi-county judicial district and a law-enforcement officer, co-Defendants in that lawsuit. The Plaintiff asserted Constitutional violations of the Fourth Amendment against the judicial district and the officer related to a traffic stop. The court granted Underwood’s motion to dismiss all of Plaintiff’s claims against the judicial district and officer.

Plaintiff then appealed the district court’s dismissal to the Fifth Circuit Court of Appeals in New Orleans. The Fifth Circuit affirmed the district court’s decision favorable to Underwood’s client, and the Plaintiff filed a writ of certiorari to attempt to appeal the decision to the U.S. Supreme Court. The U.S. Supreme Court denied Plaintiff’s writ on October 7, 2024, which ensures the victory in favor of our client is final.
