Underwood Lawyers Talk Immigration and EFTA with Local Dairy Leaders

Mark Osterkamp, of Osterkamp Dairy, and Ron Welper, the Dairy Enterprise Manager of Arm & Hammer Animal Nutrition asked Underwood to share helpful hints on an employer's compliance with I-9 requirements.  Nick Nevarez Jr. took the lead on this part of our discussion and reminded the group about:

  1. the revision to the I-9 form effective February 2, 2009;
  2. the importance of completing each of the blanks on the I-9 form; and
  3. the importance of separating the completed I-9 form from other employment records maintained by an employer. 

In addition, Nick discussed the Spanish version of the I-9 and how employers may use this version to assist Spanish speaking employees as they work through this process.

We additionally discussed the payment limit regulations published in the Federal Register on December 29, 2008, the attribution rules, and the importance of using husband/wife joint ventures, to the extent possible.

We also talked about the Employee Free Trade Act ["EFTA"].  While the Ag exemption is present, the EFTA may have implications for ag employers.
