
ICE Announces New Worksite Enforcement Strategy

On April 30, 2009, U.S. Immigration and Customs Enforcement (“ICE”) announced its revised worksite enforcement strategy. To highlight the new strategy:
-ICE will focus its resources on the criminal prosecution of employers who knowingly hire illegal workers;
-ICE will continue to arrest and remove any illegal workers who are found in the course of worksite raids and investigations; and
-ICE will use civil and administrative tools, including civil fines and debarment, to penalize and deter employment of illegal aliens.
ICE investigations can be lengthy and comprehensive. ICE cited various avenues from which tips may arrive:
-Public citizens;
-A company’s current and former employees; and
-Referrals from other law enforcement agencies.
Once a tip is received, ICE agents employ a variety of techniques to investigate the allegations, including the use of undercover agents, confidential informants, cooperating defendants, and surveillance. For a detailed explanation of the revised strategy, visit www.ice.gov.
