Diligence Before Entering into a 313 Agreement

Most of my postings are located on the dairy section of Underwood's website. If you take a look at those materials, you'll see that I've mentioned Underwood's wind energy efforts as we work in the two developing South Plains and Panhandle industries.

At Underwood's March '07 retreat our lawyers discussed the continuing growth of wind energy and the role we should play. We confirmed that we'd take steps to help current and new clients with key wind energy issues.

Our school district practice, made up of 100 or so independent school districts and a handful of lawyers, is one of the key areas in which we'll work over the next several months. Our school district clients have received and will be receiving applications for tax abatement under Chapter 313 of the Texas Tax Code.

Along with Education Service Centers 16 and 17 Underwood hosted a seminar concerning 313 agreements in Plainview on October 16, 2007. At the seminar my presentation related to the diligence that should be completed by an independent school district before entering into the 313 agreement.
